    Hey guys, i’m new here but the info on here has helped tremendously. I have my packet assembled with I-130, I-130A, I-485 & I-864. Im not submitting I-765 or I-131 because I have a EAD through DACA.

    I was about to send my packet but now I’m wondering if I should wait a little longer to ensure my interview date is after our 2 year wedding anniversary? We got married Jan 17, 2020. I know we can never know for sure, but any advice would be appreciated.
    AOS - Marriage to US Citizen

    7/28/21 - Package shipped
    7/30/21 - Package delivered
    8/02/21 - Text messages received
    8/06/21 - I-797 notices received
    8/09/21 - I-797 for biometric reuse
    9/02/21 - I-693 deficiency notice received
    3/31/22 - Interview scheduled for May 5, 2022.

    I would recommend to do it now, and include the I-693 in the package, all the EAD's receipts, pictures, sent everything at once so your case doesn't get delayed with RFE. Remember that DACA doesn't give you a path for citizenship, and you never know how things can change. I was in a similar situation (pending asylum application for almost 6 years) and I applied for the AOS three months after getting married and got approved last Thursday.

    Package: I-130, I-130A, I-485, I-693, I-864
    Field office: Oakland Park, FL

    Timeline:
    03/25/2021 - Packet mailed (USPS)
    03/26/2021 - Packet received at USCIS Chicago Lockbox
    I-130:
    04/19/2021 - Case Was Received (03/26/2021)
    07/23/2021 - Case Was Approved
    I-485:
    04/19/2021 - We accepted the fingerprint fee for your Form I-485, Application to Register Permanent Residence or Adjust Status. Our National Benefits Center location is working on your case.
    05/04/2021 - Case Was Updated To Show Fingerprints Were Taken (From fingerprints taken in December 2015 for a pending asylum application)
    06/08/2021 - Interview Was Scheduled
    06/10/2021 - Case is Ready to Be Scheduled for An Interview
    07/22/2021 - Interview | Case approved on the spot
    07/22/2021 - New Card Is Being Produced
    07/23/2021 - Case Was Approved

    I did not file a I-765 because I have a pending EAD renewal that I filed in January 2021 under the pending asylum application category (C08)
    EAD renewal still pending. Expedite request submitted on 06/04/2021 base on a possible financial loss and difficulties to renew driver's license. On 06/21/2021 expedite request was denied.

      And reading your timeline is what made me think twice before sending it now. Yours moved so fast and if that happens to me, I’ll get the conditional green card instead of 10 year.

        Remember that every field office moves at its own pace. VenfJ's case is definitely not the norm at the Oakland Park, FL Field Office. Current processing times are 9.5 to 25.5 months for that field office. The receipt date for a case inquiry is 06/12/2019. Every now and then, an officer grabs a file from the wrong file.

        It's up to you. You have DACA right now. I would personally just file. You could always reschedule your interview for any reason.

          We don't see many approvals that only take 4-5 months, so it is pretty safe to send your documents now. Most likely your interview will be in 2022 after your 2 year wedding anniversary. Good luck.

          But if you are nervous about it, wait a little longer.

            I was thinking of rescheduling if it’s cutting it close, but then I’ve read horror stories about that and needing a good reason.

              I think that is a good call. I do not know if your field office is Oakland park but that field office has always been backlogged. Most field offices are. While some are processing cases within 6 months, that is definitely not the norm.

                No we don’t have the same FO, mine is Dallas, TX.
