  • Postpone or extend response to I485 RFIE

    Hi,

I had applied for I485 last year. While my i485 was pending I had to travel to India in June 2021 due to family emergency. But now 2 weeks back I got a mail from USCIS Requesting for Evidence for Medical examination and vaccination records. I am still stuck in India as my H1B stamp has expired and with appointment for H1B dropbox were limited, I got one in mid September. So, now I cannot go back to USA for 3-4 weeks, but the RFIE response time is only 2 more weeks. I checked but looks like the medical examination can be conducted only from USA. Does anyone know if there is a way to extend responding to RFIE? From the I485 REF document , it says if I don't respond in next coming 2 week by mail, they will deny my case.

If you have received a request or notice from us with an issue date from March 1, 2020, to September 30, 2021, and you fail to reply on time, we will consider a reply received within 60 days after the response due date listed in the request or notice before we act on your case. This applies to Requests for Evidence; Continuations to Request Evidence (N-14); Notice of Intent to Deny; Notice of Intent to Revoke; Notice of Intent to Rescind; Notice of Intent to Terminate; and Request for a Hearing on a Decision in Naturalization Proceedings (Under Section 336 of the INA).

This is announcement from USCIS. I hope that helps!

I see that when I log in to my USCIS account on the very top there is a section COVID News or something, you click there and that pops up. Yes! I think that solve your issue! Good Luck!

Yes thanks, once I logged in USCIS account I could see it too. Just the RFE letter or the case status page doesn't say anything so got concerned
