  • Attorney making mistakes in forms

The attorney I hired has been working on my case for a month. I have not seen any draft letters from her and she did not provide me with a timeline for the letters. Her paralegal sent me forms filled out with so many mistakes and incorrect information including the wrong last entry date, missing my parents' names, and my correct work address. I wonder if this happened with others at such an early stage in the process of working with an attorney?. She emailed me and said that "they" are working on fixing these mistakes. I am concerned that she has a paralegal who does not know how to fill out paperwork and she obviously did not review the paperwork before he sent me. I can't imagine if these forms were sent to the USCIS it would be a guaranteed rejection of the application.
I have paid her half which is a tremendous amount of 4,500 dollars and suppose to pay her a similar amount when she submits the application on my behalf. I consulted with another office that is the Chen Immigration that so many people here know and they said that my case is likely to be approved or my money back.

What do others think of this? Does this sound normal for an attorney to make these mistakes?. The forms are straightforward and she did not even write one word yet or I have not seen anything yet. Also, she told me to do the medical exam since the first day I hired her and now I found out on my own that it is valid only for 60 days according to the USCIS otherwise the applicant needs to do it again and resubmit. Did others have similar experiences?. I have a meeting with her tomorrow and I am seriously considering terminating her services since it is still early in the process. Th only issue is to do it in a friendly way and try to get as much refund as possible from her.

    Thanks!

Thanks. I have a meeting with her tomorrow and I intend to do that. However, she was supposed to handle that and review the paperwork after the paralegal. This is business as you said and she has been an attorney for 15 years so this is not supposed to be new to her. That is the reason that I am considering moving to another attorney, this and also the fact that she asked for a big amount which now I am thinking is too much for this type/quality of work.

        Hi Member,
If you are not satisfied with Attorney service, you are authorized to migrate to another Attorney and you may surely request for refund that you have paid so far. As you mentioned, If paralegal do the clerical work, Attorney's job to finalize with all corrections, if needed.
I think, you have a rights to have a detailed discussion with Attorney and get the solution.
        All the best.
        Thanks

Thanks. I plan to do that in my phone conversation with her today. I was wondering how much time the attorney may need to prepare the application for EB-1 or EB-2?. I heard from one office that it takes 2 months. I am in the EB2 NIW category. I want to hear from those who submitted applications with attorneys. Thanks for sharing your experiences!

Just an update: I talked to my attorney and she listened and suggested mechanisms for improving communication such as to setup a weekly zoom meeting to discuss the case and any questions that I have. I also asked her to amend the agreement and to put it into writing that she will inspect all forms for accuracy from now on. I also asked to negotiate the price but she refused and suggested that either we continue with the same price, or she will give me a full refund and stop working on my case.

The amount of money she asked for is very high ($ 9000) and I am considering if I take the case from here and prepare the material by myself without an attorney. Did anyone do that for EB2 with success?. The other option is to continue working with her. I think that she is thorough and competent but this was a glitch as she did not inspect her paralegal who made all this mess. Still the price is high and I did not expect this kind of mistakes at early stage of the process. Any thoughts?. Can I apply with success to EB2 or is it unlikely to succeed?
