  • Case close to outside normal processing time

    Hi,

I'm working at FAANG company, EB2 category, ROW. My employer sponsors my green card application. We went through PERM process and then filed concurrently I-140 & I-485. My I-140 was approved eventually after upgrading to premium. It was approved on 4/20/2021. My PD is 11/26/2019. I'm waiting on my I-485 since June 20, 2020 and it's already been over 16 months. In August 2021 I received RFIE for medical records which I responded to on August 12, 2021. Since then I haven't heard back. I reached out few days ago through chat and spoke with USCIS representative and he mentioned that the case is still within normal processing times and I should wait. What other options do I have? I see people from 2021 getting already approved, which is very concerning to me. How do I know that everything is OK with my case, maybe it got lost somewhere? Should I maybe call USCIS and ask for Tier-2 support? I was thinking about doing it when my RFE response is not processed within 90 days (currently it's 76 days since I submitted the documents).

What should be my next step? Should I just wait, call them? This is really impacting my mental health as of right now because I have no idea if everything is OK or maybe the case is lost somewhere.

Your status updated to show that they received the RFE back?

I think every RFE says something about 60 or 90 days for an answer if not you can call a number. You can do that.

That's true, but when I reached out on live chat, the associate mentioned that they processed my RFE when they received it, which I guess fulfills the promise on the RFE?

      My status is currently:

Response To USCIS' Request For Evidence Was Received

On August 12, 2021, we received your response to our Request for Evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status

        Hi Member,

Answer: Since your case status is showing as Response To USCIS' Request For Evidence Was Receivedthen you are good. USCIS is acknowledged that they have received RFE. You will need to wait for really some more time to get back the status from them.
Now a days, Adjustment of status is taking bit additional time. More over yours is via RFE, you just wait for another couple of weeks to get the good news.
        All the best.
        Thanks

I think you are right. Now I'm reading that paragraph as "if no update online for 60 days, you can contact USCIS", that makes sense. It is not a promise that they will resolve your case in 60 days.

USCIS received our medicals in March and they approved the GC in August (a little over 5 months).
