    Hello,

    I would like to present my case because.

    I first entered the US in Miami in February 2012.

    Later, still in Miami, I found a job and in July 2012 I started working as an IT Project Manager with a 5 year E2 visa.

    In 2016 I started the procedure to obtain the green card through the same company that sponsored the visa.

    My priority date is July 2017.

    My I-140 was approved on 06/20/2018 (Section: Skilled Worker, Sec.203(b)(3)(A)(i)) and I just lack the approval of the change of status I-485.

    I did my interview on October, 2018.

    During the interview the officer asked me how I was able to live in Miami on a low salary (about 25k per year).

    I replied that I could support my standard of living thanks to the fact that I receive a passive income derived from royalties.

    These royalties are paid to me (1099) for the sale of digital assets that I have created in the past and are my intellectual property. In 2012 I set up an LLC company to pay the taxes of these royalties.

    I don't work for this LLC company. There are paid contractors who take care of everything. I only work for my sponsor.

    This information is proven by my Tax Return which I gave to the appointed official during the interview.

    After the interview, I didn't know anything more.

    I have tried to open several service requests over the years but I have always been told that I had to wait because my dates were pending.

    About a few months ago I was able to talk to a Tier 2 on the phone who I asked "why does my case take so long to get a decision?".

    The person on the phone confirmed to me that for some reason they had skipped me but didn't know why.

    Regarding my specific case, he said "I don't have updates for your case. Now I'm sending it to the officer in charge who will answer you via mail".

    After about a month, I received the answer to the question "why does my case take so long to get a decision?". The reply was "we have updated your address".

    I found their response inappropriate and meaningless.

    So I decided to contact the congressman in my area, who in turn contacted immigration for explanations about my case.

    Within a couple of days the congressman received an email from immigration (which he sent to me by post) saying that I have to show up (after 3 years) for a second interview. The letter from the congressman is dated October, 2021,

    To date I don't know anything, so far no second interview has been scheduled.

    Personally, I have a vague feeling that my case has been lost in the system. I don't have the proof but it's just my feeling because I can't understand why so much time has passed.

    Reading on the internet, I found some immigration attorneys saying that sometimes this is due to background check issues.

    I took my criminal record from the Miami PD and it's clean. Also, through an agency, I sent my fingerprints to the FBI and they too replied that there is nothing and everything is clean.

    That's all.

    I would like to know what you think about my case and any suggestions you may have would be great.
