  • I-485 Initial evidence help

    My wife came to the us with a K1 visa and now we are working on getting her form I-485 finished up. In the instructions it asks for Initial evidence to be submitted with the form, but all of that was submitted with her K1 visa except for the marriage license and K1 approval notice. We were wondering if we still need to resubmit all the evidence we submitted with the K1 again with I-485, or will the K1 approval notice along with the marriage license be enough?

    Think of the Adjustment of Status as a brand new process because it is. When they open your package, they will not be looking at, nor have you K1 file on site. Go through the instructions carefully and include what they ask for---passport, I-94, birth certificate, translations, affidavit of support, immunizations, etc. The EAD application and advance parole (I-131) will ask for some of the same things as the I485. Like 2 passport photos each --so that's 6 photos if you apply for all 3 at once. (which you should because the other two are free if filed with AOS.)

    As a K1, pay attention to who is posting in this forum because if they are adjusting from a visa on which they were already living in the US (student, work) then their filing requirements will be different from yours. For example, you don't do an I-130, or take another full medical exam, or send evidence of your relationship. If you are selected for an AOS interview, you will take evidence in person so begin collecting joint accounts, both names on insurance, photos together...things like that. Many K1s get processed at California Service Center and get the green card without interview.
