  • married to a US citizen with a tourist visa

I recently married a US citizen and according to my visa I'm allowed to stay here until February 20th.
The problem is I'm still collecting my immigration papers like getting my certificate of good standing / non-criminal history form.

its going to take time to get it and I might get it a little after I turn illegal and then I could submit my immigration papers.

I know that being illegal could make problems with your case, but is submitting my immigration forms just a few days after I turn illegal could make my case more complicated?
Because of a form that takes time to get?

You do not need certificate of good standing for Adjustment of Status (I-485).

Being out of status, for whatever length, does not affect Adjustment of Status in the Immediate Relative category (spouse, parent, or unmarried under-21 child of US citizen). That said, you are deportable in the period of time after your status expires and before you file I-485, so you should avoid or minimize such period of time.

This is my personal opinion and is not to be construed as legal advice.

I was in similar situation, I married a usc and by the time we submitted paperwork I was a few weeks past my stamp in the passport. My attorney told me it doesn’t affect anything as it’s forgiven when you file for aos to a married usc. No need to worry.

I’ve been in this situation with my alien spouse. Nothing will happen. You will be fine.
