  • Refiling I-485 application for a minor under 14 years after Initial rejection

    Hello Altruist,

    I need your help.

I have applied for US Permanent Residency (form I-485) along with my son, who is a minor (age 6.5 years), and my spouse.

My son's application is rejected and returned from USCIS as we didn't sign his form.

We are going to refile his application. However, we are in doubt about the application fee.

Usually, the fee is $750 for a minor under 14 years when the minor's application is sent with at least a parent. Otherwise, the fee is $1140 when a minor applies without a parent.

I am in doubt whether the refilling for my son's application will be considered as without a parent or with parent.

Your feedback will be highly appreciated.

Did your rejection notice come with any particular instructions about how to correct the error and refile? Something like "make sure to include a copy of this letter when you re-file"?

Yes, USCIS provided a green paper that say to resubmit the application and include the green paper in the application.

My guess is that this is a "can't accept the form as is, fix it and send it again" and not a "full rejected and start as a new application".
In other words, fix the error, submit all the paperwork and original payment, and don't forget the green paper.
        This is only my guess.
