  • Tax filing adjustment of status spouse

I’m currently filing an adjustment of status application for my wife., We recently got married in November 2021 and at the moment live in separate states.

Does anyone know if it is advisable to file taxes jointly as married? If we file as single for now would it raise difficulties in the approval process or raise questions?

    Any input would be helpful!

Since you were married as of December 31, 2021, you are not allowed to file as "Single" filing status for 2021. You must file as either Married Filing Jointly or Married Filing Separately (or in rare cases for spouses who live apart who have a dependent, Head of Household). In almost all cases, Married Filing Jointly is equal to or better than Married Filing Separately, and it is more likely to be a lot better if there is a big difference in the two people's incomes.

Does your wife have an SSN?

This is my personal opinion and is not to be construed as legal advice.
