  • Adjustment of Status of a parent by a newly naturalised citizen

Hi There, My mother is here on B2 visa , she has already for 6 months and currently she is on her 1st extension. I have applied for my Naturalisation and received my interview date so My question is Can you petition for your parent once you receive your naturalisation certificate or do you have to wait for US passport . If her 1st extension is over can I apply for 2nd extension and then meanwhile apply concurrent filing of I-130 and I-485 i.e Adjustment of status for her.
    Please Reply .
    Thanks In Advance !

Yes, I-130 and I-485 can be filed as soon as you take the oath. You can use a copy of your Certificate of Naturalization. You do not need to wait for a US passport.

They should not apply for B2 extension of stay since they intend to do Adjustment of Status so would be lying about their plans to leave. They do not have to be in status when I-485 is filed.

This is my personal opinion and is not to be construed as legal advice.
