  • AOS for parent (B2 to GC)

    Hi all,

I am planning to apply for AOS for my parent who is in the US on a B2 visa (stay over 90+ days at this point). We had no intent to file for GC until now due to current pandemic conditions in our home country and restrictions that make it difficult to travel back and forth. I have seen posts on here about being careful when applying for AOS from B1/B2 due to the issue with intent to stay. Are there any documents that anyone has used to show that the intent has changed during the stay in the US? Or will a letter from the petitioner suffice? Thanks in advance.

From what I understand you don't need to prove the change of intent to start the petition. In other words, you need to start the AOS process and if they ask for documents to prove that there was no intent to immigrate when your parent arrived in the USA, then you do that.
