i have been reading posts on this forum but i never replied or respond to anything. Today i would like to share my complex immigration journey.
i came in US on J-1 visa in 2018 and two months after arriving i applied for asylum. until now i am still waiting for my asylum interview and i requested an expedite interview in 2020 and it was approved but still now not yet scheduled for interview. at the same time i have a friend we applied for asylum at the same time he got his interview in April 2019.
In September 2019 i self petition for Extra ordinary skill for green card EB1. i sent my I-140 and when my priority date became current i sent my I-485 package.
i got a RFE for my I-140 to submit required evidences. Even though i already sent them with my initial package. i gathered new evidences again and submitted them within the window time i have been given. After two months my i-140 was denied due to not enough evidence to support my application. After two months again my I-485 was denied due to no immigration visa available i guess it was because my I-140 was denied that lead to I-485 to be denied as well.
In August 2020 i got married to USC and in December 2020 i sent my I-130 alone and in March 2021 i sent my I-485 while I-130 still pending.
Here is the time line for my I-130:
December 10, 2020: We received your Form I-130, Petition for Alien Relative, and mailed you a receipt notice.
December 1, 2021: We are actively reviewing your Form I-130, Petition for Alien Relative. Our records showed nothing is outstanding at this time.
December 2, 2021: Case Approved
Here is the time line for my I-485:
March 26, 2021: We received your Form I-485, Application to Register Permanent Residence or Adjust Status, and mailed you a receipt notice
May 10, 2021: We scheduled you for a biometrics appointment. However i did not go because of my past biometrics in the system. they reuse what they had.
January 13, 2022: Interview Was Scheduled. My interview is on Fev 11, 2022.
we are busy preparing the interview and my immigration journey i never worked with a lawyer i do everything by myself. i already wrote letter to withdraw my asylum case and i will send it once my green card is approved.
i know they will ask questions about my pending asylum case and previous I-485 for EB1 application i am prepared to answer that and this time is family based so it won't be a big deal.
After my interview i will post how things will go until the final outcome.
Today Fev 11th 2021 we completed our interview. here is the description.
The interview was at 10:45 am we came at 10:00 they did not let us in until 10:30 so we were hanging out in the car. once we got in we passed the metal detection and we have been given a seat in the lobby. they were one couple came with their lawyer and they were practicing questions all the time. the officer came and called our name to follow him to his office.
Here is where things got interesting. we got to his office before seating he made us take an oath to tell the truth. before going to details of the interview the officer was really professional but the interview process was really unprofessional and suck. The interview took 1h 25 min while we spent only 5 min talking to each other. The rest of the time was idle time where the officer was struggling with technology.
apparently USCIS migrated to digital platform where no more manual work is allowed. i don't know if the software was not installed on his computer but at the beginning he told us he has to install the software it will take him 17 min and he said while waiting give him your I-130 approval notice and the child BC. He said he can see my I-130 was approved but he needs that notice. i told him i submitted all those document online and he logged to my online account.
First question of the interview :
1. Did you apply for EB1 employment green card and was denied ? i replied yes
2. What's your BOD? i gave me my DOD
3. Is anything changed since you applied your marriage application? I said yes, i moved to a new city and we have a baby.
Then he called two of his supervisor to help him with IT issue then they told him they can't do anything he has to submit a ticket to IT. but they tried to help and spent 1h trying to update the system and the suggested him to continue a manual interview.
Then the officer moved to yes or No question. after that he asked me sign and he told me i could've signed it electronically if the system was working and approve it on the spot but since the system is not working he can't approve and he can't even update the status in the system online but he gave me a interview result paper saying i am recommended for approval and i should wait for approval letter. He never asked my wife anything because I-130 was approved before the interview.
Is the worst interview because i got there at 10:45 and since morning they knew they had IT issue but they waited until im there to try to work on that. i got bored in front of the officers while they fixing that issue which took 1h.
