Sorry if this is covered elsewhere. I downgraded from eb2 to eb3 in Oct 2020 and my I-140 for eb3 is not yet approved. I am still with the same employer and have eb2 I-140 approved. My PD in EB2 just became current and noticed the option to inter file. My employer said that downgrade was a 1 way street and are not going to upgrade again but as I see it’s a zero cost thing. Can I do inter file on my own? Any one else in the same situation?
