  • Best Visa Options?

    I met a woman from the Philippines on an international dating website some months ago. We've been talking and video chatting for hours almost every single day, morning and night. We have the same family oriented goals and we have a strong connection. However, I'd feel much more comfortable about marrying someone after living with them for a while first. Sometimes relationships can seem perfect when they are long distance, only to gradually sizzle out after the couple finally gets together.

    I understand the tourist visa to the US is good for 6 months, and I believe 6 months would be plenty of time to figure out if we are a forever-kind of match. However, when researching this topic I read that there are harsh penalties if someone comes to america with a tourist visa with the intention of potentially getting married. I understand the fiance visa is meant for this kind of visit to the US, but I also understand the fiance visa is only valid for 90 days. I don't believe 90 days is enough time to live with someone to determine if it's going to be a lasting marriage.

    I am employed full time here in the states (a born citizen with a successful career) and on top of that I also run my own business, so for me to stay in the Philippines for more than a few days wouldn't work.

    Are there any options available to us for her to come and stay with me for more than 90 days before we marry? I'd really like at least a few months of time with her before we decide on marriage, which to me is a serious life-long comitment.

    It sounds to me like the only option is for her to get a tourist visa, to come visit and let me show her all the popular tourism sites, then after 6 months she goes back to the Philippines (without any marriage), then we next plan on getting her a fiance visa to return to me. Is that the only option available to us? If so, does anyone have any idea how long it would take for her to get a fiance visa after just returning to the Philippines after visiting with a tourist visa? Is it even allowed?

    She can always apply for tourist visa stay some months here then go back and apply for fiance visa. Sometimes people are able to adjust directly form tourist visa as well just need to be done carefully I guess. If she came here with an intent to visit places, but then you proposed that's not really intent to immigrate because she came here as a tourist not as your fiance or to be your fiance. Also keep in mind that tourist visa does not allowed working here, so if she comes for 6 months you need to figure out income (may be she can work from home for her current job there or something like that).

      It sounds like you’re switched on regarding spending a good amount of time together before jumping right in.
      I arrived on a tourist visa (B1/2) just after Covid shut down the world. I met a girl, we dated some and then we vacationed out of the country for a week and I then got another 6 months stamping back in. 3-4 months after that I proposed and we got married pretty quickly afterwards. My marriage green card came through within 10 months of applying through adjustment of status.
      I think the real morale is if the marriage is the real deal then you will have nothing to worry about.
      There are also plenty of immigration attorneys that will give you a free consultation.

        We were looking into the tourist visa route and we don't think she qualifies for a tourist visa because she's been unumployed since the start of COVID-19, and she doesn't own any property or land because she lives with her family and has never married.

        Does anyone know if there's a way I can use my financial history to vouch for her that she will be able to return to the Philippines at the end of the 6 month tourist visa? I'll be the one buying her tickets and covering her travel expenses anyway.

          Can lawfully permanent resident apply for unmarried son over 21 years adjustment of status? If son is present in usa on student visa? Please advise

            Yes. They will be in the F2B category:
            (F2B) Unmarried Sons and Daughters (21 years of age or older) of Permanent Residents: 23% of the overall second preference limitation.
            The only problem is there are GC available for cases before September 2015 for most countries and before October 2011 for the Philippines and before September 2000 for those born in Mexico.               So it will be same time if he is present in usa or in india right? I thought if beneficiary present in usa adjustment of status will help to get early green card. Thanks.
