Hello,

My wife filed for me and I am now at the stage where I recently applied for removal of conditional status. I got a one year extension while they consider the application. I understand that if everything goes right then I will get a 10 year Green Card soon.

My question is about my kids. They are still undocumented, ages 12 and 16. Up until now, we did not include them in any of the filings because of the cost in attorney and USCIS fees. After the the initial filing, We have been bypassing the attorney and doing the filing ourselves. From my research, it seems all I need to do is to file form I130 and I485 for each child. Is this correct? What will the process be like? Will they need to attend an interview too? Thanks in advance.

You did not do the right thing!!!! Did you ever mention in your application that you have kids????????????

Hi Daru,

Yes, I did disclose that I have kids and they are undocumented. I think on the I751 to remove conditional status I was required to list all my kids and their statuses. All my filings were true and complete. I am very curious as to why you think I did the wrong thing.

Because you should have applied for your kids and yourself at the same time. I am not expert but your 16 year MAY have a problem. Please contact a couple of attorneys who offer free consultations and see what you have to do right away. I may be wrong but do your due diligence and get them the legal status as though they rightly deserve.
