October 2020 i485 filing - RFE arrived in mail more than 3 months late!

  • October 2020 i485 filing - RFE arrived in mail more than 3 months late!

    I filed i485 in October 2020
    I got an RFE in the mail for medical recently, and it is post marked mid April.
    However, RFE is dated January 2022, and date for responding is early April 2022 so that it is already in the past.
    Work says there is a 60 day extension in effect for responding to RFEs due to Covid and so I have some time, but I'm worried that it is too little time.
    Anyone else have such an experience?

    You should be able to get your medicals in 5-7 days time from your USCIS approved physician and submit it within the 60 day extension timeline. Also, check if you have to send it to your local FO or USCIS processing centers. You can find the USCIS approved physicians in their website. It might cost you between $150-$400 depending on your city.

      I would use Emma to talk with customer service and explain the situation. At least they will have records that there was a delay in delivery. See which authorized civil surgeon can do the medical faster. Good luck.

        Thanks for the responses. It is not my local FO. Rather Newark, NJ FO. The address I have to send it to is on the RFE.

        I was thinking I should try to respond within the Covid 60 day extension, but still also raise a service request for "Did not receive notice by mail" saying
        RFE was dated so and so date in jan, due so and so date in early april, but it was postmarked and received only so and so date in late april after the due date. I am still trying to respond within the Covid 60 day extension. I understand USCIS is very busy at this time, but can you kindly grant me any leniency in case I am not able to respond within the COVID 60 day extension? Thank you!
        Something like that. So in case my response doesn't make it in time, the worst is they ignore the service request. But best case, they might be lenient and issue another RFE?

        Does that make sense? Or is there any harm in raising a service request like this?

          Sorry, I don't have experience with that. The best bet is to send the sealed envelope soon. Good luck.
