  • AOS vs CP : What do I gain ?

    Hi Folks, I had a very basic question. I am trying to decide
    which way to go. Nowadays, as the things are going at CSC
    (thats where my case would be processed), PDs are becoming
    current very quiclky. As a result, I-485 is being filed as soon
    as your I-140 is being approved. Is this true ?

    Given that, and the fact that I can get an EAD within 3 mos
    of filing 485, timewise, I am not gaining much (more so,
    because the current rule allows one to change jobs 6 mos
    after filing of 485).

    One thing that I dont know is, what were the PDs of the
    485 cases that are being "APPROVED for GC" at CSC today ?
    That would give me an idea of how long of a headache do I
    save because, as we all know, CP guarantees a GC within 4
    mos time.

    Also, How much time is one having to wait after 140 approval
    to be able to file for 485 for EB2 RIR @ CSC ?

    Do any of you immigration gurus have any info on this ?

    1. Yes, it is true, I-485's are being filed as soon as I-140's are approved because all work categories are current. Therefore, it no longer really matters which category you file under, i.e., eb-2, e-b3, etc.

    2. Employment based Green Cards rarely, if ever, require you for an interview. All CP cases require an interview at the foreign consulate from where you're a citizen...major headache, especially if you get a jerk for an interviewing officer.

    3. Currently, my office is getting 485's back within 6 months from CSC. For my money and time and headache, AOS at the CSC is the way to go.
