  • EB1C concurrent filing in 2021 - Any success stories?

Has anyone got their GC for EB1C filed along with AOS in 2021?
I mean all filed in 2021 but GC may be now or 2021.....read somewhere that all this transfer and approval is only for non concurrent ones and concurrent filers may be stuck in NSC or TSC for sometime

it seems that every case is different and for every post you read about transfers and approvals, you'll see another one that contradicts the first. This is the frustrating thing about it. USCIS seems to have no discernable process...it's all so very random.

How do we define concurrent filing? For example if I file my I140 and then shortly after (a few months or weeks) file my 485, while I140 is still pending approval, how would that be considered?

We filed I-485 ((c)(9) - employment based) concurrently with I-765 (and I-131), receipt date for all is 6/1/2021. EB1C (employment based).
We got our EADs (I-765) two weeks ago. Nothing on the I-485 since the first notice.

            Interfiled Medical in March 2022.

I am hoping that the fact that the I-765 got adjudicated means that the I-485 will also get adjudicated soon.

                thats sad.
                You can do 2 things.
Write to ur congressman for expedite..USCIS may not entertain, but if the officer comes to know there was a query on that case, he/she may approve. They are in a hurry to utilize all visa numbers. May be drawing attention may help.

Pls ignore if u have already done

Hang in there u will get it soon. I am also stuck..no EAD/AP or GC. I140 is approved.

Congratulations. When was your I140 approved? Also did you submit your medicals at the time of concurrent filing?

Thank you. It has been close to 80 days since I filed my RFE response. I am not sure if upgrading my case to premium will help. The premium processing timeframes for EB1C is 45 days and not the standard 15 days so I am a bit skeptical about spending the additional $2500 while I should typically expect a response for my RFE in another 10 days even without upgrading to premium.

i understand ur delimma.....Either spend 2.5k and hope u will be approved this year...OR..since the backlog is cleared, and they promised 6 months max processing time, dont spend 2.5k. Either they will automatically do this year or max in 6 months next year u may get...tough call

The dilemma is because even if I spend 2.5k, I won't definitely get my GC this year (before October) because the premium processing time could take up to 45 days, after 140 is approved, it would take a month or two right there to transfer my case to MSC (worst part is that my 485 was with MSC initially and they transferred it to Nebraska) and then I haven't submitted my medicals yet (thanks to my attorney' office for not letting me file 693 alongside 485..!! ) so another month lost there and finally getting 485 approval after responding to RFE would be another 2 -4 weeks. So everything is in order, it would be a minimum of 4 months from now, even if my I140 was to be approved tomorrow. It's so frustrating.
