  • What is the USCIS processing time to a RFE response?

    Need a suggestion - I responded to a RFE for my I140 on May 02nd. USCIS will now allow me to submit a premium processing request for my pending I140 starting Jul 01. It is already more than 70 days since my RFE response was filed. I'm wondering if it's worth spending $2500 to request for premium processing of my RFE response (which would mean my case would be possibly processed in another 45 days from then) or just wait as it would have been 115 days since I submitted my RFE response by then.

    Is there a max time before which USCIS is expected to process a RFE response? When I search online, there is no clear answer while in many places it says that I should definitely get a response within 90 days after USCIS recived my RFE response.

    I have an EAD/AP combo card so my motivation to get my I140 processed quickly is with a hope that my 485 would be picked up for processing shortly after. I still have not submitted my medicals, as recommended by my attorney to wait until I get a RFE so significant time is expected for processing of my 485 even if it's picked for processing shortly after.

    Hi Shiva... For me it took 2 weeks for I140 to approve. That was before premium processing was introduced.
    I am wondering why would they take so long to process the RFE. Did your attorney give any reply with any tentative numbers based on the RFEs they have submitted in and around the time you have submitted?
    Did you raise any SRs for inquiry?

    If i understand, with the introduction on premium processing for I140 for EB1C, there is not enough evidence to prove what is the ideal timeline to approve the application.
    I think for you, it must be a game between having mental peace vs patience Isnt it?. I think 45 days for approval is still hypothetical date but you should get within a week because this an extra income for them to pick the application from the bottom of the list to the top.
    If I were you, I would rather pay this amount so that I can be on the main queue for GC. Who knows, if they approve your I140 and pick your I485 form simultaneously as well...

      Thanks rln8316. I wish that they would pick up 485 for processing at the same time when my I140 is approved. USCIS says that for concurrent applications, they would process the 485 simultaneously at the time of approving the underlying petition, if a visa number is available (which is true in my case) and the file is documentarily complete (which is not in my case as I haven't submitted by medicals).

        The processing time for I485 for Nebraska is back to 18 months now ( hope u get lucky soon)

          Thank you guys. Keeping my fingers crossed. I decided to not premium process but to wait. Let's see.

                I have seen with my friends n me. Whenever we have requested for level 2 officers(when level 1 was not able to ans), we saw some moment in our application. I don’t know if it’s true or fluke. I don’t know if it’s worth a try.

                  How do I get to a level 2 officer? I have not been able to reach level 1 officers, leave alone level 2. Can't get past the robot agent.

                    No Matter what is the robot response, just keep saying Live Agent ( copy this, and keep pasting) At somepoint u will be asked if u have any case then enter reciept number.Then u will be added to queue. When I tried there were 56 ppl ahead of me and my turn came in ~30 mins. Some will ping u and ask ur address dob,receipt number phone etc. ..then u can ask ...good luck...

                    Yeah as someone said, our request to expedite something in 2019 was rejected but in 2 days there was a movement.....

                      Will try. In the past when I've tried, I get disconnected from chat abruptly because of some issue and I have to start all over again. Or my messages won't go through and the agent would disconnect the session assuming I'm not responding.Thank you.

                        Try a different browser and make sure you don't have a browser plugin that may be the problem.

                          It was same with me bcos I wanted to know if our medicals were received.
                          last week on Wednesday I tried at 8an EST. After asking abt my medical to Emma. I mentioned live agent. Luckily it was able to connect me with tier 1 officer. He didn’t have any idea so he raised a request. If it’s emergency I believe they call within 48-72 hrs else 30 days.

                            My medical RFE was approved within 1 week of submission.

                            July 30, 2022 Got Green Card delivered by priority mail

                            July 25, 2022 Case Was Approved
                            June 29, 2022 We sent a request for additional evidence for your Form I-485, Application to Register Permanent Residence or Adjust Status.
                            June 13, 2022 We transferred your Form I-485, Application to Register Permanent Residence or Adjust Status, to another USCIS office that now has jurisdiction over your case.
                            June 10, 2022 Your Form I-485, Application to Register Permanent Residence or Adjust Status, was transferred to another office for processing.

                              Ultimately, the decision to request premium processing should fit your personal and professional goals. If you are anxious to apply for a green card as soon as possible and can afford to pay for premium processing, this may be a reasonable option.
