  • Out of USA and priority date current

    Hi,
I am in a situation where I am in Canada and changed my employer who originally filed green card. My priority date got current and cant apply I-1485 because I am outside of USA.
If I want to move to US in future:
    1. Can I still use my priority date to proceed filing GC?
    2. Would I be able to use my approved I-140 anytime to re-instate h1b, after the priority date becomes current?
    3. Would there be any impact to my existing approved I-140?
    4. Would I have to find an employer to file H1B which wont be cap-exempt and have to undergo lottery system?

I raised this question on avvo but there are very varied answers which confused me further.

If anyone got into such a situation, and wont mind sharing your experiences, that would be really helpful!! Thanks!!

Is the employer that filed I-140 for you still offering to employ you after you immigrate?

This is my personal opinion and is not to be construed as legal advice.

      hi,
yes, I can join the employer who filed the original I-140. But getting into US with that employer may not work out immediately.
