  • Conditions for AOS (Marriage base) (help please)

I am looking for your help. I am confuse about AOS process and its conditions for marriage. What are the conditions under which one can apply for AOS base on marriage to a US citizen. E.g.
How long the couple wait for marriage to take place in order to be eligible for AOS.
How long the couple should know each other before they get married.
What documents are needed to apply for the AOS.
what if someone met through on-line dating?
    Looking for your best advise.

You can apply for AOS as soon as you get married.
They can know each other for a few months to several years. Just what normal marriages do these days.
The documentation needed is several forms, they change the requirements from time to time. Best to read the instructions for forms I-130 and I-485. There are other forms that are free (at this time) I-131 (Advance Parole) and I-765 (Work Permit).
There are many marriages through meeting using online dating/social media, don't worry about that.

You need to prove that the marriage is real. Put together evidence of dating, marriage, finances, living together and so on. You can read many cases on this forum with very good information. Good luck.

Thank you Enub4 for taking the time to answer my query. It's been a confusing topic for me for the longest time. I am glad, I get the facts straight.

The document's requirements, I was referring to, is what personal docs, I have to submit (e.g. Birth Certificate (orig), Driver Lic, Police Records (from place of residences), extra? If you please give some details about it.

Do they check social media conversations between couples ( Whats App, Face book, emails)?

Also, once I apply for AOS, can I travel outside of America. My parents are very old, emergency situation can happen anytime. How fast the travel docs can be ready (if required urgently)?

Enub4, I look forward to your answers. Appreciate your guidance tremendously.

      Thank you.

HI Maza - All this information is available in this forum. Just search the forum and you will be able to find lot of posts which discusses this. With respect to traveling outside the country after applying for AOS, you will be allowed to AFTER you have an approved Advance Parole (AP). You can apply for an AP, free, along with your AOS. It usually takes a few months to get your AP approval. If you would like to travel before your AP is approved, USCIS has a defined process for requesting an Emergency AP in the case like you just mentioned where you can request for an appointment in USCIS office and if they find your requirement to travel outside to be an emergency and genuine, they will provide you with a temporary AP for your immediate travel.

If you travel outside US without an approved AP, your AOS will be considered abandoned.

This is just based on my knowledge so please refer to an attorney for legal advice if your case is complicated.

I don't have experience with marriage AOS, this information is just from what I read.

The required documents list should be in the instructions section for each form, in general, birth certificate, marriage certificate, passport, photos, not originals but copies and if the documents are not in English then a translation.

I have read posts from people that they print emails, ******** and ******** conversations to support their case. Also photos together from trips, wedding, etc. Credit cards together, loans, leases, even gym memberships.

Once you apply for AOS you need to include form I-131 to get AP, you should not travel abroad until you get your AP. There is an option to expedite but I don't know much about that. Usually, it takes between 6-12 months to get the AP, some people doing AOS never get the AP and they receive the interview appointment between that timeframe and get the GC without receiving AP. Good luck.

Adjustment of Status (AOS) for Green Card: If you are a dual citizen, (from 2 countries) do you require to bring both passports (originals) from both countries for the interview and when submitting the application (I-485 ). Also can they accept photocopies for required documents including passport.
