  • NOID Out of Status

My wife just received a NOID saying that she was out of status when her application was filed...

She was originally on a TD Visa but the expiration date did not match my TN so we called CBP to see if they could update her I-94 to match mine and they did.. but now USCIS is saying that their records indicate that she was admitted until the TD Visa expiration date and ignored her I-94...

Anyone else has experienced this or knows what we can do?

Do you have a copy of the I-94?

This is my personal opinion and is not to be construed as legal advice.

Of the updated one? Yes. It can be downloaded online on the website. We also included it in the package that we sent.

Make sure to save a copy of it, since it may not stay on the I-94 website forever (you can print the page to PDF or something). I am not sure what you can do other than to send the copy of the I-94 to them again, and explain that CBP originally put the other date on her I-94 in error, and they later corrected it, and according to the corrected I-94, she was in status at the time she filed I-485.
