Mismatch of date of birth in certificates

my date of birth is not matching with my passport's date of birth. I tried to get non availability certificate and our municipality is saying they cant provide non availability certificate since the certificate is already there. my priority date is nearing to be current. So I think its a risk to change the passport and all the documents now since it will take more time. Anyone tried without non availability certificate and birth certificate. my attorney is saying just file with affidavit from parents.Will it work? Anyone went through similar situation?
