  • General Status Check/Question

    Hello,

I (US citizen, based in California) filed for green card for my mom and dad (both aged ~76) as follows -
    • Parents (nationality - Indian) entered US in Feb’ 2022 on visitor (B1/B2) visa (valid until 2026)
      • I-94 ‘Admit Until Date’ - Aug, 2022
    • Concurrent filing - I-130, I-485. Also submitted I-131, I-864, I-765 and I-693 (sealed medical tests) with the same. Physically mailed the entire packet (including the above mentioned forms and supporting documents) to USCIS Chicago lockbox address - ‘USCIS, AOS, P.O. Box 805887, Chicago, IL 60680’
      • Filed in Apr’ 2022
    • All of the receipt notices (I-130, I-485, I-131, I-765) have receipt numbers starting with ‘IOE’ and the USCIS office address (in the bottom left corner on the receipt notice) is listed as ‘USCIS, National Benefits Center, P.O.Box 648003, Lee’s Summit, MO 64002’
      • We received biomterics/fingerprinting appointment notice (for I-485 and I-765) for both my parents for May 2022 and duly completed the same
      • On the I-797C notice for biometric/fingerprinting appointment, Service Center is listed as ‘NBC’

We haven’t heard anything from UCIS after the biometrics appointment. The online case status (for both my parents) for -
    • I-485 and I-765 indicates - ‘Case is being actively reviewed USCIS.’
    • I-130 and I-131 indicates - ‘Case was received and receipt notice was sent’

As I-485 was in processing/pending state, I did not file any ‘extension for stay’ application even though it is past the ‘I-94 Admit Until Date’

    Wanted to check -
    • If there is anything I can do to expedite the processing of our cases? Or just wait to hear back from UCIS?
    • Is ‘NBC (National Benefits Center’ the USCIS Service Center for our case since all of the receipt numbers start with ‘IOE’?
    • It would be strongly recommended for my parents to not leave the US until they get their EAD/AP card card, correct? If they were to leave the US before they get their EAD/AP card then their existing green card application would be automatically canceled and we would have to restart from scratch when they come back net to the US?
    • What should I expect next (if everything goes well)
      • SSN number?
      • EAD/AP card?
      • Approval notice?
      • Actual green card?

    Thanks in advance

    correct

The I-130 would continue, but the I-485 would be abandoned. They would switch to Consular Processing abroad. They would not be able to enter on a nonimmigrant visa again with preconceived intent to file I-485 on that stay.

SSN should be automatically issued after EAD approval if they requested SSN on I-765 (or if green card is approved before EAD, then SSN should be automatically issued after green card approval if they requested SSN on I-485).

This is my personal opinion and is not to be construed as legal advice.
