    First of all thank thank you very much for this great website. It has been very helpful. Second, I have some question filling out the application and would like some help if possible. Im applying for greencard through marriage and I've been living in the USA for over 2 years.

    1) I live in NYC and asked for my criminal records, it will take around 10 business days to be processed.So, meanwhile should I only send my I-130 and wait for the criminal record to send I-485 and the rest or should I wait and send all of them together. Or even maybe send all the forms and send my criminal record later??

    2)I changed my name and I want my greencard to come with my new name. Does my passport have to be switched as well (I just renewed 6 months ago and it can take up to 2 months). Does the criminal history have to be in my new name or it has to be according to the passport?

    3) On file I-765, question 11. Have you ever before applied for employment authorization from USCSI? I was an Au Pair- J1 visa 6 years ago and I have social security number, does this apply for this question?

    4) G-325 -I arrived back in the USA in August 2008 with a tourist visa and I changed my status to F1 in February. On the item Applicant's employment last five years,should I put unemployed for all this time or unemployed/student??

    It would be great if you could help me with at least some of the questions. Thanks a lot.

    I think it's always best to send a complete application. You can't keep sending bits and pieces and expect them to get matched up. An I-130 alone is for a US citizen who has a spouse living in another country who needs a visa to get in the US. That's not what you're describing. So the I-130 and I-485 need to be submitted together because the beneficiary is already in the US.

    There's a lot of things that need to also be sent with the forms like a medical exam by a civil surgeon (Form I-693).

    I don't think police clearance from the foreign country is part of the I130/I485 submission. It's part of the visa process but you're not applying for a visa. Any criminal checks for time in the US is done by USCIS via the FBI so you don't ask for your own US criminal history.

    Apply for the greencard in your married name. Your marriage certificate will be the proof of why you have a new last name and different from the maiden name. If you are changing your name drastically--like a new first and middle name, then that requires a court procedure. But taking your husband's last name only needs a photocopy of your certified marriage certificate included. In the future, travel with your marriage certificate to show why your green card and passport names are different until your passport expires, then change the passport.
