  • Questions about I-864 and I-693

Hi, I have applied for the adjustment of status based on a marriage to a US citizen in October. I sent the following applications: I-485, I-130, I-765, G325A and 2 weeks later I received receipts for all the following forms, but like a 10 after I received another letter from USCIS saying that they are requesting 2 more additional applications: I-864 and I-693. Unfortunately, I thought that this forms was required only in the I-485 interview and that's why I didn't sent it. Whatever, first question that I have is that, I already did medical exam, but Im little bit confused about what to do, because doctor gave me some closed envelope along with my I-693 application, and I just wonder do I have to wait until interview or send it right away??
Another question is about I-864... So, as I know minimum income gotta be $20,000 but my wife's income is worth $10,000 and I know that we need a sponsor and my uncle is going to do that for me, because he's income is more than $40,000 and I just wanna ask you guys how many forms do I need to fill out? I mean do my wife have to fill out I-864 separately? and if yes does she needs to send her last 3 years tax returns??

    Thank you.

You got a request for evidence (RFE) because those things should have been included. Send everything back at the same time. Include the RFE letter so they match it up with your file. Make a photocopy to keep for you records. They gave you a date for when it has to be back to them. Do not miss the date or you can be denied.

I-693 medical exam: Send the sealed brown envelope. Look at your copy and make sure your name and information are correct and the doctor signed it. Get him to re-do it and seal again if you notice any mistakes.

I-864 Affidavit of Support: Download the instructions and the form (two separate things) and read them for help.

    Wife:
    I-864

    2009 tax return with W-2 form(s) (photocopies)

    Uncle:
    I-864

    2009 tax return with W-2 form(s) (photocopies)

Some other proof of his income like photocopies of 6 pay stubs or a letter from his employer stating he is employed full time for __ hours per week and earns a salary of $_______.

Proof of uncle's legal status in the US (a photocopy)--US born birth certificate or US passport or green card or naturalization certificate.

Thank you so much for your response, and one more question, do I have to send only 2009 taxes or last 3 years?

They usually ask for last current years tax return but attorney advise you to send last 3 years.

They used to require 3 years, but that rule was changed to 1 year around maybe 2008. If you read the instructions for the form, it says send the most recent tax return. It says the two before that are OPTIONAL, but you can send them if it makes your case look better.

So for wife, it doesn't matter because she doesn't qualify anyway and one year for her meets the requirement of sending the most recent return.

For uncle, lets say his are 2009-$40,000; 2008-$20,000; 2007-$18,000.
The two previouse would not make him look better. I would not choose to send those.

But if uncle had 2009-$40,000; 2008-$39,000; 2007-$41,000. Those make him look very good, so you could choose to send three, but only the most recent is required.

Read the instructions on the form.

Most recent year's tax return should be fine. Doesn't have to be three years. That's what my sponsors did in my appl. Turned out to be no problem.
