  • Interview - I-485

    I am worried.

    i declared that I work. i am not supposed to. will this affect the decision on my I-485?

    i will have my interview next month.

    i didn't hire a lawyer.

    your input is greatly appreciated.

    It depends on a couple of different things.

    If you are the immediate relative (IR) of a USC, they forgive it.

    If not IR, there are limits on the amount that will be forgiven.

    If filed under the "penalty" 245(i), it is also forgiven.

    You have not provided enough details on the subject to get your question answered.

        thank you both (BigJOe5 & Daru 789) for your quick response.

        i applied for i-485 on marriage base. i am out of status for 8 years already.
        i've been working using someone's SSN, my name though. and on the form, i declared i did.

        what worries me is that. the interviewer might make a big deal on me working when i am not supppose to. i do have a ITIN though which i used to file taxes.

        now i am wondering if i need a lawyer.

        also, i heard that there's a penalty i have to pay for over staying. is that true?

          I believe your un-authorized employment will be forgiven. Penalty in some cases is $1000.00 but I think you may not have to pay. Lastly DO NOT admit if you used **** documents to obtain employment.

              yes i am married to a US citizen.

              Daru, that's what i am worried about. its obvious that i used a **** documents to work. i can't work if i can't present anything to the employer.

                  LOL!!!! I haven't lied about the **** documents. y? nobody yet has confronted me. employer hasn't found out yet. Thank God.

                  anyways, i seek a lawyer advice. this really worries me.

                  when an out of status person is working, it is forgiven if that person is married to a US citizen. that's what the lawyer said.

                  and the IO dont asked about who's SSN are using, where do get ur **** documents... that's what he said.

                    I too am working without a authorization. I have an attorney and he told me not to worry about it, they rearly contact the place of employment. I just had my interview and the question of work did not come up. I too don't want my job to find out my status, especially before I get my greed card.

                          No- my passport was not stamped. I ask the interview if I could travel prior to obtaining my greed card and he suggested that I wait until I get it in the mail. My sister had her passport stamped, but her approval is conditional since she has been married for less that two years. I was concerned with the fact that my passport was not stamped, but was put at ease went the approval notification came in yesterday. If you haven't don't it, its a good idea to create a profile on the USCIS website. It helps with tracking the progress of your case(s). You can setup your profile to get text or e-mail notification any time the status of your case(s) changes.

                            Ok. since you said you are working without authorization, I assumed you used someone's SSN and a **** GC to work. Now you have an approved I-485. i am wondering if you plan to change your information (identification,status, SSN) with your employer.

                            will your SS contribution be transferred to your SS?

                              Its a long story USgurl, but I have a working SSN number in my name so I don't plan to change it.
