NVC processing to Adjustment of Status

Hi There,

Immigrant visa petition for both my parents got approved few months ago, unfortunately, in the mean time, I lost my dad and now I got my mother here, as she had visitor visa valid till 2012. Since my mother cannot live alone and don't want to take here to India for Consulate processing, I'm preparing to file for adjustment of status, here. However, I'm not sure what documents or forms I need to submit, in what order and where? Please let me know if anyone knows the process or point me to someone how does.

Just file for adjustment and include a copy pf the I-130 approval notice for mom's petition and copy of her I-94 etc, per the form instruction. To avoid getting mail about dad's petition, inform them of his passing both along with mom's application package to USCIS and also to NVC. You as petitioner, must file the I-864 appropriate to your situation along with required evidence.

Thanks, one more question, where do I file I-486, at local office, via email or as per the instruction? Though she has 3.5 month left on her stay, but in case we don't get any reply in the mean time, can she stay?

Obtain the forms (I-485, I-131, I-765 and I-864--for you, perhaps the EZ version of that form), instructions, current fees and filing addresses. Read and follow the instructions carefully, include all required evidence. You must include the I-130 approval notice as a basis for filing along with a copy of her I-94.
