  • Question about I-864 (Tax returns and W2)

Hi, I have applied for the adjustment of status based on a marriage to a US citizen in October. I sent the following applications: I-485, I-130, I-765, G325A and 2 weeks later I received receipts for all the following forms, but like a 10 after I received another letter from USCIS saying that they are requesting 2 more additional applications: I-864 and I-693. I already did medical exam, I just little bit confused about I-864. My wife requested the most recent tax returns from IRS and it just came in, but the problem is that we don't have any W-2 forms.. I just wonder if we just gonna send this IRS print tax returns it ain't gonna be enough for them, or its extremely necessary to do so?? because anyway, she don't have enough income and we have a sponsor.. If it's necessary please guys tell how to get W2 forms fast and easy?? I know that, there is an option to directly print it out. Thanks you

I don't know what you wife ordered because there are several thing one can order from the IRS. What she should do is get IRS Form 4506T (Request for Transcript of Tax Return) and check the box ordering a RETURN TRANSCRIPT by checking box 6a on the form. That is different from an account transcript 6b or the other things listed. You can fax the form in. See the second page for fax numbers or address to mail depending on the state where you live. It is free.

So if you send a tax return transcript to USCIS, you don't need W2s because everything needed is in the transcript and verified by the IRS.

When people send a copy of their tax return they print off from TurboTax or filled out on their own, the USCIS must see the W2 to go along with it as additional proof of the income. I could fill out a **** Form 1040 and say I made $100,000 a year, so that's why the W2 has to go with copies of the 1040 tax return to show some proof.

If she got a tax return transcript from the IRS, then that's all you need.

      Nichole,
That's exactly what we ordered. Tax Return Transcripts from IRS.
