Hi everyone, hoping someone has faced a similar issue and has found a solution. I’m applying for my dad’s 485 AOS. One of the requirements is to provide his birth certificate. He is 85 and born way before 1970 (reciprocity). He has his Indian passport, aadhar, PAN and some recent medical records. I read that someone who has been alive at the time of his birth has to provide an affidavit but there are not any that was close to him at his birth that are alive now so getting an affidavit from someone who knows about his birth and older to him is almost impossible. What are his alternatives to get past the BC requirements for AOS? Thanks in advance for any advice to get past this hurdle.

Hi,
I think birth certificate is only applicable for those you are born after 1970.
Below is a link from Consulate general of India for non- avaliablity for those who are born before 1969.
Maybe you can have a letter with your explanation + non-availability from Indian consulate + aadhar/pan may help for this purposes.
You can also apply without these and wait for RFE sometimes they might not even look into these and approve as long as other documents looks correct.
