  • I-485 RFE DOB mismatch : how to get consulate approval for passport DOB correction

    Hello,

I find that several of us have gone through similar scenarios where your actual DOB is different from passport, mark-lists, PAN etc. I received a I-485 RFE asking for proof of birth or non-availability even after providing affidavits based on school certificates and passport.

I have never had a birth certificate. So I inquired with municipality and obtained a fresh birth certificate with the correct date. I am applying for passport DOB correction, but I was informed that I need to get an approval from consulate. The only way to reach them is via email, as they do not pick up their phones. My consulate is SFO and I have emailed them at [email protected], but have not received any response. I have scheduled an appointment with VFS tomorrow to give rest of the documents. They're saying they'll hold my application for 20 days and send it back.

What is the best way to get a hold of SFO consulate for these kind of issues? Thanks for your help!

did you try emailing - [email protected] or call - 4156680683 (ext- 167)- There used to be passport officer in the name of HS Negi who responded to my email.
You can also email- [email protected]

My experience was back from 2021 when consulates are operated without any appointments. It was difficult to reach anyone to get some headway in this process. I had to email all the contact under contact list in SFO website and tweet Ministry of external affairs to get some response.

Back then, i felt SFO was better than Houston in terms of response based on the experience shared by other people in this forum. Good luck!

Thanks man. I got a response asking me to email at passport.sf. So I emailed them today
By the way, I see you had a similar scenario as mine. Did you get your 485 approved? @rln8316

Desai786 I am waiting for my attorney to get back on the list of documents. Mostly it will be affidavits explaining the situation

It has been a week since I emailed passport.sf and the passport2.sf addresses. I also sent couple follow-ups. There is no response at all. The phone is also not reachable

It is frustrating. Do they take more than a week to respond?

Desai786 Here is what I did. Sorry about the delay as I had no response from consulate for 4 months

-- I got the BC based on the new and actual DOB.
-- My attorney and I prepared a response to USCIS with affidavits from parents that I was never issued a BC before and that my mark sheets were used as evidence for all government documents. And that I am working on correcting my passport to reflect the new DOB
-- I emailed consulate for passport DOB correction approval and did not get any response for 4 months
-- I filed a request for court order in India. They contacted the consulate and asked them to process my request
-- The consulate emailed me the questionnaire and provided the approval last week
-- I will be submitting the passport next week for DOB correction
-- USCIS status says they received the RFE response and the case is pending. They are waiting for visa to be available.

                    prknts - Hi,
Good to hear that things are finally progressing for you. Good Luck!!
Quick question, Where and how did you request for court order in India? Because i’m from a small town (karnataka, India) even with the attorney’s we couldn’t get the court order in my case and got rejected twice. Now im left with last chance to apply for court order else i’ve to take my case to high court.

Hi Desai786 sorry for the delayed response. I received my court order directly from the high court. My lawyer in Kerala prepared the affidavit for my mother and submitted to the court stating the need for correcting the DOB. The fact that I never had a birth certificate was stated in there. The court accepted it and ordered the consulate to process my request for passport.
