Filed I-130 & I-485 but bank blocked the visa payment

  • Filed I-130 & I-485 but bank blocked the visa payment

    Filed I-130 & I-485. I dispatched my application pack on Sep-25-2023. It reached Carol Stream Lockbox on Sep-26-2023. They tried to charge the payment from my Wells Fargo Visa Debit Card. Bank blocked the payment thinking it was fraudulent. My packet is coming back. I would not advise personal cards to be used for this purpose. Use law firm professional cards made for this purpose or use Certified Checks or money orders. My attorney did not tell me this. My I-94 is expiring on October 1st. Will it have any kind of effect on me.

    Assuming you're in the Immediate Relative category (the only family-based category that can file I-130 and I-485 together right now), it doesn't matter if you file I-485 while in status or out of status. So in the worst case, if it gets rejected, just file again.

      It does have an effect on you. In cases if your marriage ends. Your time in the country after the expiration of I-94 will be considered as illegal.
      Furthermore incase you get a greencard and you are applying for a visa of, lets say Germany. They ask you if you have over stayed in any country. You need to say yes because technically you have over stayed after the expiration of your I-94 and your visa can have a problem.

        It will make essentially no difference for any bans. As for an "effect" on the probability of being approved for a future visa application, that's just speculation.

            You said "It does have an effect on you." Well, describe a specific way it affects a future application. "considered as illegal" is not a well-defined term in immigration law.
