Hey everyone. My friend is married to an US citizen. She used a lawyer to apply for her and her daughter's ( daughter is 13) green card. She applied for i130, 1765, i485. However, the lawyer decided not to put in the daughter's the same time he did hers. These forms were put in June 2010 and since then she has not heard from her lawyer even though she called his office and went there on numerous occasion. Two months ago she checked her USCIS account online and it states that they sent 1797 rfe for missing documents so she called the USCIS and they keep telling her to call back in 30days. She decided to contact a new lawyer this friday and she is saying that if she takes up the case she would apply for the daughter now and it will take 1 year. She doesnt understand why the other lawyer didnt send in the daughter's papers along with the mother's ( The other lawyer was also given all the fees for the daughter's forms along with my friend's fees). She now has to pay again over to $3000 to this lawyer including the daughters fees again and also the lawyer's fee.
Her questions are :
1. Can she let the new lawyer finish the paper work for herself alone and then do her daughter's on her own?
2. Can her husband file for her daughter alone or does it have to include her (the mother's) filing?
3. Is there a way she can get back the money from the previous lawyer for the fees she paid for her daughter which he didnt file.
We would appreciate any advice you have in reference to this situation. She really doesnt have the $3000 to pay now.
