  • Fbi background check

To cut it short I was detained & charged by ICE with Inadmissable due to 212(a)(2)(D)(i) (I did not do this in the US) and to coming on a unvalid green card (it's valid i just have not been present long enough)

Both is on NTA however my removals court document does not have my inadmissable charge. Only states my charge for not being present on my removal proceedings info document.

I was released on recognize as I was not a risk, I was giving a court date for 2025 was let into the US, on a temp green card & authorisation to work. I have no prior criminal history prior this.

I was told by an attorney "You wouldn't get a citation or criminal complaint as you didn't break any laws. It only pertains to your resident status. If they eventually do an ICE warrant or hold if detained for removal, it will show up. Otherwise, it won't." Followed by "It's not actually a charge. It's just a reason they could deny you entry. You can't go to jail or anything, they will just deport you if anything.

You weren't arrested, charged or convicted with a crime, it won't show up" will this go on my fbi background check

I am not a legal professional, but I can offer some general information. If you have been detained by and have charges related to inadmissibility, it's important to consult with an immigration attorney for advice tailored to your specific situation. However, I can provide some general insights:
    1. FBI Background Check:
      • FBI background checks are typically related to criminal activities. Inadmissibility issues, while serious in an immigration context, may not necessarily result in a criminal charge that would appear on a standard FBI background check.
    2. Immigration Status:
      • Inadmissibility issues are often related to immigration status and may not always lead to criminal charges. However, immigration matters can be complex, and the consequences can vary based on individual circumstances.
    3. Consultation with an Immigration Attorney:
      • Given the complexity of immigration law, especially when dealing with charges related to inadmissibility, it's crucial to consult with an immigration attorney who can provide accurate and up-to-date information based on your specific case.
    4. ICE Detention and Removal Proceedings:
      • Detention and removal proceedings are primarily related to immigration matters. While they may not result in a traditional criminal record, they have significant implications for your immigration status.
    5. Legal Advice:
      • Seek advice from an immigration attorney to understand the specific nature of the charges against you, the potential consequences, and how they might impact your immigration status and future entry into the U.S.
