  • Urgent RFE for I-485 for multiple spellings of first name!!

    Hello Everyone,

    I had applied for my I-485, and received a receipt for it on 17th Sept. 2010. But on 13th Dec. 2010, I received an RFE for my I-485 petition. The RFE states that the USCIS has discovered that my name has been spelt in multiple ways in the various documents that I have submitted along with my I-485 application.
    The scenario is such that in my birth certificate, my name is spelled as Samule. That is not how I spell my name. But because of the mistake in my BC, all of my high school transcripts have my name spelled as Samule too.
    My name is spelled correctly in all my passports though, i.e. Samuel. And now after coming to USA, all my documents in these past years, such as, my I-20s, Bachelor’s and Master’s Degrees, I-140s, EAD card, even my driver’s license have my name spelled as, as Samuel.
    Now, USCIS is requiring evidence to proof that the spelling of my name that I am currently using is valid and legal.
    Can somebody please advice me, as to what my next steps should be, and what sort of documents would I have to collect in order to proof my case?

    Tough one. You would have to officially change your name to prove it is correct following the name change procedure in the court. Going back to the old name should have been done on the Passport long time ago. Now you might have to stick with the new spelling and go with the legal means to change it.
