  • I-864 Affidavit of sponsorship questions

My husband and I are about to apply for green card process. By adjusting my status (i am an f-1 student), we needed to fill out the I-864. My husband is unemployed right now and doesnt meet the minimum income. I own a house here in florida out right and i receive 900 rent every month so i listed this as my income to achieve the minimum required annual income. Since i havent had to file my taxes here yet but only in germany i can only show them my rental agreement. I also understand that i do not have to fill out the i-864a since i dont have any dependents. Additionally, i printed out the property appraiser site for my house to show i own it. Any thought if that is enough?

Can you explain who is the petitioner here you or your husband? The I-864 is for the petitioner and W2 and 1099 and tax returns must be presented for 3 previous years or just recent 2009. You have to show that you exceed over the poverty line for however many people in your household. You can find this on USCIS site for a guideline. If not then you will need a co sponsor.

If your husband's income is not enough, you should add other sponsors, preferably someone from your husband's side, his brother, sister or parents etc til the the income level meet the poverty line, your income or asset can be a help but it will be better have something from your husband or other family side.

My husband is the sponsor. I am still a german citizen and he is petitioning for me to have my status adjusted since im on an f-1 visa here.
My husbands income right now is only about 15,000/year. He earned more this year because he worked for four months but his monthly income from unemployment is about $15,000 this year. It is only him and I in our household. And i own a house out right just inthe next town here and i am renting it out. and I receive $900 a month.
It says on the form that if i will continue receiving the income once my status will be adjusted i can use it. And i will continue receiving it thats why i submitted it. With both of our income we easily make the poverty line requirements.
So can i add my income and simply show them the copy of the lease to show my income will continue? My parents just bought me the house last year so this is the first year i received this income and therefore i havent had any tax returns on it since i am an f-1 student.

If your income plus your husband's together over the poverty line, that is good, however, since your husband is unemployed, they may have the concern about the future income, I highly recommend you get an additional sponsor, as far as i understand, the additional sponsor doesnt need to be from the same household, your husband should have some family or relatives right? otherwise, i heard even if you put a friend as ur sponsor, it will still be acceptable.
