Can you file I-130, I-130A, I-864 and I-185 together for marriage based to US citizen if the petitioned entered the USA through the border?
My friend got married to his spouse a few months ago, they have been together for a bit over a year now and my friend has been in the USA for almost 3 years now. He is now filing his case but he stated that because he entered the country through the border he has to file I-130 and I-130A first and can’t file I-485 at the same time unless he has an approved I-130, is this true? To my knowledge when me and my spouse filed for adjustment of status we sent everything together in a single application, but my spouse was here on a work/student visa, so he entered the country legally, but doesn’t the same apply to file everything together to my friend? With the exception that he needs to file the removal waiver as well?
