    I am i-140 approved in EB1 category (L1A) and waiting for Priority date ( India) to be current. I have an issue that i am not able to get the NABC from my place of Birth Municipality as i do not have any evidence of birth of the place that is mentioned in Passport. I am 52 years old and my parents left the place of birth when i was about 1 year old.

    What is the alternate solution to this problem? Will USCIS agree with only the mandatory Affidavit that is from my mother and one other relative?

    - If you are 52 year old, then i m assuming your year of birth would be around 1971-1972. I thought you dont need Birth Certificate for year of birth before 1973 for India? I could be wrong

    Did you submit your I485? If you are still in dilemma whether or not to submit, my advice would be to go ahead and submit I485 minus Birth certificate or any available evidence you may have.

    I had similar issue with my BC (different date in BC vs passport.. there is a post in this forum). There is some legal firm in India who does NRI support which also includes procuring Birth certificates. One of the firms I reached was legalnexus though i did not seek their services, but you can do some google search for your due diligence.

    Other option is to get the affidavit and attach any other documents or you could procure NABC/ Birth certificate from counslate for year of birth before 1973.
    I have noticed most of the time, they dont even check into the details most of the time but that is sheer gamble you should take. I spent my time and effort to make changes in my passport but i have seen my other friends who filed with whatever documents they have or just waited for RFE got approved without any questions. So ahead with your documents and just wait for your luck
