  • Switch from AOS to CP

    I highly appreciate somebody can help me with this case:

    I am on AOS (I-130) since year 2009.Everytime i go to USCIS office, always have got same answer: Background check,you have to wait.
    Although I have my EAD ,it has been hard to find a job due to current economic situation in the US.
    I have a travel document but can't stay overseas more than 180 days.
    I have been offered a job overseas which I'd like to accept but I am not sure.

    question: Would it be wise to switch from AOS to CP and accept a job overseas? or switching is only authorized for I-140 and not I-130?.

    On what basis was your I-130 filed? Filing and I-130 is not AOS.
    In most cases if you leave the country, your I-485 will be deemed abandoned.

      This is what I have done so far:
      I-130 petition of relative (married to Us citizen)
      then I-485 (AOS) and
      Biometrics done in 2009.
      few times visited USCIS for further info.same answer: wait still on background check.
      In Feb 2011 will be almost 2 years waiting.
      Is it always like this?
      Can switching from aos to cp will give me at least the chance to work at my home country while waiting for Consulate interview?
      Or such switch is only for I-140 applicants and not for I-130's?

        Hello Kenny - Couple of question:

        How did you enter US?
        What was your status when you got married?
        Have you taken infopass appointment?

        There is something wrong in your case, it shouldn't take that long. Usually it take anywhere from 6 months to 8 months.

        Is there anything else which you have not stated?

          i have been legal all the time
          infopass :Ok
          I have no idea why it is taking so long.
          Hopefully they will call me for interview this month.I cross my fingers.
