earlier this year in Feb 10 2024, we submitted a full package for Green card based on Marriage with some evidence of marriage. I am a USA citizen filing for my Canadian wife. We submitted through our lawyer Form I-485, Form I-130 and Form I-765 in one package. We also submitted their respective fees Form I-485 filing fee + biometrics fee: $1,225, Form I-130 filing fee: $535 and Form I-765 filing fee: $410. On 03/12, we received form I-797C - Noticed of action stated that the form I-130 has been rejected. The letter said “The payment amount is incorrect, or has not been provided. Please review the form Instruction for the fee information. Please resubmit the application/petition package with the appropriate fee to the address listed on the bottom of this page.” We called the immigration officer at USCIS support to asked question regarding this notice and we were told that we need to separate the forms and their fees then resubmit. We did exactly that by separating the forms I-130 in one package and the rest of the I-485 package in another package with their fees. We included money order of I-130: $535 I-485 with biometrics fee: $1,225 I-765: $410 I-864: no filing fee for USCIS filing I-130A: no filing fee (included with the I-130).
Then we received another form I-797C - Noticed of action on 04/06/24. The letter stating that “Your form I-130 form is being returned to you because the eligibility you files under requires that you file an I-485 also. Please resubmit both forms and the appropriate fees in order to continue processing. Any advice in this issue. Looks like I have done what I was supposed to but they keep rejecting.
