  • Applying Green card for my mother - adjustment of status i-485 and I-130

    Hello Everyone,

I am in the process of applying green card for my mother with the adjustment of status. My mother is widowed and she never had marriage certificate and I got to know that during the process of green card, I will be asked for her marriage certificate. I know there is no way to get it now since the marriage happened in 1983 with presence of relatives and big celeberation in India and back then people dont even think about marriage certificate except when its a court marriage. My question is , can I use a affidavit from relatives who were present at the wedding as a substitute to marriage certificate for USCIS green card process? if yes, can some one please share the format of the affidavit so that I can use the exact wording in order to avoid any rejection?

    Your help is highly appreciated.

    Thanks,
    Anu

Where did you get that? I-130 for a mother-child relationship does not require a marriage certificate.

This is my personal opinion and is not to be construed as legal advice.

Well, it doesn't say that in the I-130 instructions, so you can at least file I-130 without worrying about it.
