  • I485 with overstayed status

    I have an overstayed status. My parent who already become a citizen is sponsoring me for PR. So far, the I-130 is approved and case is transferred to National visa center. I contacted National Visa Center. They said if I already stay in the US, I have to contact USCIS for futher information.
    My questions:
    Will I be able to proceed with my i485 application due to my overstayed status? Are there some kind waivers?

    How long have you been out of status?
    Unfortunately I don't see USCIS approving your Adjustment of Status with you being out of status. There may be some possibilities but you need to be more specific about your first entry, your age at that time and how long have you been out of status.

      I came with F1 visa in 2001 and went to school for a year. Due to financial problem, I postponed my study and started to work. I'm over 21 years old. I read waivers like i245 and i601. Will either one help my case? Thanks!
