  • Please help... Possible layoff!

    Following is my situation,

    I filed for AOS on May 20,2001. I have still not received ND or RD from my lawyer. Now a new company has bought out our company. There is a fear that the new company will lay off some more people.

    1. What are my options?
    2. If I get EAD before lay off then can use that to find another job?
    3. Can I continue with GC or I have to start with H1-B, LCA, I-140 and then AOS (keeping old PD)?


    Please help ....

    According to my research , the following are to be noted:

    - If you were laidoff within 180 days:

    Safest option:
    It is better to have another H1-B ready, and then the whole GC process (PD transfer is possible).

    Not much safe option: if your AOS is unadjudicated within 180 days, you still have the possibility of getting your GC approved. Mind you, it is only a possibility but no gaurantees, but i have heard at various discussion forums, that it happened in some cases. Even M.U.R.T.H.Y says that it is possible.

    Be brave man!! Wait and see.

      I am kind of scared as I have waited for the present GC for 4 years.

      Question - Can you please explain the situation in which there is a possiblity of the AOS being "unadjudicated"?

      Am I safe after 180 days from filing? or
      Am I safe after obtaining EAD? or
      Am I safe after FP?

      Any help is appreciated as there are not many cases that I heard of after the new law of 180 days.

        You are definitely safe if 180 days passed after filing, don't even worry.

        180 days is the key, not the FP.

        A case can remain unadjudicated, if INS hasn't asked you any RFE OR if they don't set you up for an interview within 180 days, asking you for your current employment documents. This is based on my understanding, better consult a lawyer if you want more details.

          Is it possible to work for company B if EAD is obtained through GC processing from company A

          1. on a full - time basis?
          2. on part time basis?
