Hi everyone, I came on a R-2 visa dependent on my dad. My dad filed his AOS 3 years ago EB4 religious worker when the date was current. After that the date retrogressed and I entered on R-2 visa. Due to ineffective assistance of counsel, I filed my AOS when the date was not current and moreover uscis received it in error and issued me an EAD. I went ahead and worked on it thus violating my R-2 visa. After 3 months, my i-485 was administratively closed because the date was not current and "should have been rejected" according to the notice. The notice nowhere mentioned ead. So can I apply for i-485 before my i-94 expires when my date becomes current again for have I voided my lawful status?
