My wife and I are US citizens. My wife applied for her mom (who is currently with us in the States on tourist visa). She applied in September and still waiting on the i-130 to be approved. A mistake my wife did was not filing i-485 concurrently with the 130.
My MIL's i94 is expiring on the 17th. From what I understood because my wife is a US citizen, her mom can still remain in the United States and continue to wait for her green card? We are planning to file the 485 this week itself. My wife is in a bit of a panic mode and is trying to gather all the docs together and is worried that she needs to get the 485 received before mom's i94 expired. I told her that shouldn't be the case as per the verbiage I am seeing. We have all the docs together except for the medical records. Should we file the 485 regardless? We can get her vaccination records by tomorrow and was thinking of putting that in and wait for an RFE. Or, should we wait and get the complete medicals sorted out?
