Denial of I-485 on account of priority date not being current
Hi,
Here is a quick case summary:
applied for EB-2 - Approved I-140 with priority date of November 2012.
re-filed under EB-1 - Approved I-140 with priority date of November 2023.
Since, earlier priority date can be ported across the EB-2 to EB-1; lawyers filed for adjustment of status.
Completed medical for self and family.
within 1 week, received appointment for biometric - fingerprinting and signatures.
After completing biometric step, within 1 month, received approvals of I-765 and I-131 - received combo cards (EAD + Advanced Parole).
About 4 months after receiving the combo cards, received I-485 denial letter in mail, with following reason:
I don't understand, why they deny I-485 for the reason of priority date not being current; when they had already accepted the application packet based on the earlier priority date and having it processed for EAD and advanced parole.
Can anyone help me understand this?
