I have an AOS interview in March. the problem is I don't have my passport coz it was confiscated by the USICS office in my area. I'm married to a US citizen. Is it possible to go to the interview without my passport, what should I do?

Do you know why they took it and kept it? Is your interview at the same USCIS office? They may give it back to you at interview or I would be ringing to find out when you can have it back as you need it for interview.

Passport absence no worry. I-94 absence great worry.
Hello dear don't worry about your passport, but do you have your I-94 card or a copy of it to show that you were inspected at entrance or a copy of your passport with the I-94 inside of it, is suffice. Since they nolonger stamp your passport after the interview, so if they ask for it say it was consficated by ICE( most likely and not uscis).

It was taken by ICE saying that they would give it back when my case is done. I ask them what happens when my interview date comes and they said I should have thought of that before I went out of status And I do have a copy of my passport and my I-94 (which they also asked for).Last edited by swatchie; 02-05-2011, 06:39 AM.

Hello Swatchie you should have kept a copy of it for yourself, they may size your passport but not the copy, it is abuse of powers( though they don't even have the right to seize your passport without a court order because it is the property of your native country, however since this is America, Oh their America). Just tell the adjudicator and the record will already being in the record of proceeding( A-File with USCIS) anyway, so the adjudicator will be aware of it and if not there , he or she will confirm it from ICE. This will only delay the final adjudication or decision on your case. Be prayerful and watchful.

I did ask them to make me copies of the passport and I always have extra ones with me since life here is always about having a copy of it anyway. I wish I knew they could not take it then, it was very suspicious too...they told me right at the end that they were taking it...saying it was so I would not leave the country. I would think it will harm them in no way if I did. But who knows with those people. Hopefully everything works out.
