Hi Gurus,
This is my situation. Please help with your advice...
I am not able to decide between counsular processing in Mexico vs 485.
My wife is on H1,applied green card thru regular, now completed the advertisement stage. Her 6-yr limit expired in March 2001. She filed H1 extention under new rules for another year in March 2001 before expiry date. Dont know wheather will get approved or not !!!
I thought by doing 485, I can get her the EAD status to continue to work and travel docs to travel in case of 911.
We have two diffrent lawyers working on both of our cases.
My lawyer says
a)wife cannot travel eventhough she has travel doc till 485 is approved.
b)wife cannot apply for 824 with me in mexico
c) Assuming that I just got thru in Mexico, still my wife has to wait for 485 approval ??
d)will take two years+ to get my wife a GD holder, after I got thru in mexico..

my lawyer says,wife cannot get approval for extention of H1
since labor not approved.
