Fill two 485 with both husband and wife as primary

Hi,

My spouse and I both have PD current and 140 approved. We work for different company but in same geographical region within CSC region.

Can we file two 485 in paralle and claim spouse as dependent on both applications? Especially if we file at about the same time?

Do we need to take medical exam twice? FP twice?

At what stage do we have to withdraw one case? Or is it even necessary?

I don't think you can do that. I talk to my lawyer only one of you can have AOS pending at one time. if you both file the AOS, the INS will merge the case. I am not sure it is true or not, since INS is not well organized.

Consider This

One of you goinng for CP and the other for AOS. This way, You are assured a faster processing. Hope this helps.
