Urgent: Anyone has any input for this?
I am the US citizen.
Wife is an F1 student. Requested AOS for her & had biometrics done 01/2011. Priority date 6/2010!
Step son is F1 student, just turned 21 y.o. 3 days after we submitted AOS request for him in 01/2011 . Received a I-797 rejection notice requesting the original I-130 with priority date. My question is are they referring to my wife's original I-130 or do we have to submit an I-130 (for him) in conjunction with the I-485,I-325A,I-864 & I-765?
Also we submitted the fee ($1070) for him, but were told "NO remittance required if you have successfully filled the I-485 after 6/30/2007". Are they referring to my wife's I-485 or his own (which was rejected obviously)?
